How do I prove negligence?
In order to win a personal injury case there must be proof of negligence. Your personal injury lawyer will work with you in proving the five elements of a negligence claim. These elements are:
- Duty of care
- Breach of duty
- Factual causation
- Legal causation or remoteness
- Damage
Basically, these elements are legalese indicating that there was a reasonable duty that was not performed by the party you are suing, that there are facts that prove that the duty was not preformed, and that damages were received as a result.
