A woman was killed in an Iowa truck accident early Sunday.

According to a statement from the Iowa State Patrol, 24 year-old West Des Moines-resident Riki Lee Ogden was pronounced dead at the scene of the crash, which occurred on Interstate 80 about two miles south of Adair. Investigators determined that Ogden was traveling west on Interstate 80 in a 2008 Jeep Patriot truck shortly after 5:00 a.m. when the accident happened. Troopers say her vehicle crossed the median, rolled over, and came to rest on its wheels.

According to the accident report, Ogden was ejected through the sunroof of the truck. She was found in the roadway by response crews.

It is unclear at this time what caused Ogden to lose control of her vehicle, police said. The accident remains under investigation by the Iowa State Patrol.

Our thoughts and prayers are with the victim’s family and friends.

Seat Belts Not Used in Most Fatal Crashes

Posted on February 16th, 2011 No Comments

New statistics show that 76 percent of fatal Iowa car crashes in January involved motorists who failed to wear seat belts.

According to preliminary data from the Governor’s Traffic Safety Bureau, there is a significant increase in January over the five year average of 32 percent of deaths involving no seat belt use. “There’s no question, seat belts save lives” said Bureau member Larry Sauer. “The fatality total this month is so unfortunate. If these folks had taken a few moments to buckle up, they might be home with their families right now.”

Preliminary crash report data show that 21 lives were saved in January by seat belts. According to officials, the number of lives saved by safety belts in 2010 reached 184.

Close to 93 percent of Iowans use their seat belts when traveling interstates and highways, officials said.

“As snow continues to fall this winter, the importance of wearing your safety belt should be even clearer,” said Iowa State Patrol Colonel Patrick Hoye. “It would be tragic to continue this unbelted fatality trend into February.”

$525K Settlement in Rikers Island Wrongful Death Lawsuit

Posted on February 10th, 2011 No Comments

A $525,000 settlement has been reached in a wrongful death lawsuit filed against New York City by the family of a Rikers Island inmate who died in 2009.

The New York City Medical Examiner’s Office determined that Rikers Island inmate Clarence Mobley’s death was a homicide. Mobley was found dead in his cell at the Anna M. Kross Center on May 3, 2009. According to court documents, the lawsuit claims that the guards failed to provide Mobley immediate medical attention after he was subdued by three officers.

Attorney Rudy Velez, who represents the Mobley family, told reporters the settlement was finalized earlier this month in Bronx County Surrogate’s Court.

The New York City District Attorney’s office says no criminal charges have been filed against the correction officers named in the lawsuit.

Mobley had been arrested on attempted burglary charges.

CPSC Issues Warning of Firework Peril

Posted on July 1st, 2010 No Comments

The Consumer Product Safety Commission issued its annual warning of the danger of fireworks. They recommend going to watch a display put on by professionals rather than trying them yourself.

WQAD reports the CPSC estimates that, “in 2009, two people died and nearly nine-thousand had to visit an emergency room after being injured by fireworks. Most of those injuries happened to people under the age of 20 with many accidents resulting in the permanent loss of a limb.”

The Iowa product liability lawyers of LaMarca and Landry, P.C., advise you to stay safe this Fourth of July. Do an internet search for your local fireworks display and leave the work to the professionals while you sit back and enjoy.
