The report, which was released this week, determined that the 21-year-old driver had a BAC of 0.373. The legal limit is 0.08.

The fatal accident happened in a construction zone on Interstate 29 near the Little Sioux exit. Four motorcyclists traveling southbound were struck by the drunk driver when he crossed the center line while headed northbound in his pickup truck.

The four motorcyclists, who were heading home from a motorcyclist convention, were killed in the crash. Criminal charges against the drunk driver are pending an official report from the state crime lab’s toxicology unit. In the meantime, he remains incaracerated. He already faces a civil suit filed by the widow of one of the motorcyclists, who alleges that his negligence was the primary cause of the collision.

Sheriff’s department officers were able to determine that the young man had been drinking alcohol before driving. His impaired ability to operate a car led to a crash that killed his 18-year-old passenger and classmate.

The teenager’s lawyer refused to comment when contacted about the case.

Police arrived to find the vehicle abandoned. They were able to identify the owner of the car from its registration papers, and after a short search located two 23-year-old women intoxicated in public.

According to the women, they were in the car when it veered off of the road, rolled over, and slid down an embankment into the river. Police were unable to determine which of the women was driving at the time.

Both of the women were sigificantly intoxicated, so either way it was a drunk driving accident.

The accident happened last Sunday as the man was headed west on his motorcycle with his wife riding passenger along 268th Street toward 481st Avenue near Iowa’s Gitchie Manitou State Park. He rounded a bend too sharply and lost control of the motorcycle, throwing both of them from the bike.

Police report that both the man and his wife were responsive when emergency personnel arrived around 7 p.m., but the woman passed out shortly after. She died later that night at Avera McKennan Hospital.

While police have not released the results of a blood-alcohol level test, it is known that alcohol was involved in the accident. Randy Sample, Deputy State’s Attorney, says that investigation is still ongoing as to whether or not the driver will be charged with vehicular homicide.

“Normally, for vehicular homicide, you need two things: You need to be intoxicated, and you need to be involved in a negligent act,” Sample said.

Neither the man nor his wife were wearing helmets. The driver remains hospitalized at Avera McKennan Hospital with serious injuries.

The accident occurred around 5:43 p.m. Both cyclists were stopped at a sidewalk on Bowery street, waiting to cross Gilbert street. The 22-year-old driver was waiting at a red light westbound on Bowery street, waiting to turn south on Gilbert street. When the light changed, the cyclists crossed the intersection in a westbound direction while the driver turned southbound, hitting them both.

Both cyclists were taken to University of Iowa Hospitals and Clinics with non-life threatening injuries. Police report that the drunk driver had an odor of ingested alcohol, bloodshot eyes, unsteady balance, and slurred speech. His blood-alcohol level was significantly over the legal limit.

On March 4 around noon, the 26-year-old man crashed the car he was driving into the Salvation Army building. The man failed the field sobriety test and had a blood alcohol content of .101, according to officials. The man had reportedly just ended a personal relationship.
