Is there a statute of limitations for Iowa personal injury lawsuits?

Posted on December 3rd, 2009 No Comments

According to Iowa law, the statute of limitations for personal injury lawsuits is two years in most circumstances. This means that a plaintiff can file a personal injury lawsuit within two years of the incident that caused the injury.

If the injury occurred over a period of time, such as a work-related injury, then the statute of limitations is typically extended to two years after the last day the individual's injury was aggravated.

What if someone is injured in a rescue attempt?

Posted on December 3rd, 2009 No Comments

When car accidents occur, oftentimes paramedics are not able to be on the scene immediately. Because of this, many witnesses to the accident usually can respond to the accident more quickly.

While not every witness will try to save any injured drivers or passengers, some may try and may wonder how their legal liability will be affected. Assuming the witnesses are performing reasonable safety measures, then they will likely not be charged with a personal injury claim if they further injury the injured parties.

However, if the witnesses are injured in the process, they likely will not be able to sue for damages from the people who they were trying to save.

If you or anyone you know has been injured while trying to save someone else, contact the Des Moines personal injury attorneys of LaMarca & Landry, P.C., at 877-327-2600.

How to file a personal injury lawsuit against a taxi company

Posted on November 19th, 2009 No Comments

Many people use alternative means of transportation every day. For instance, instead of using a car, some people will take taxis, buses, or shuttles to work each day.

Like all other types of transportation, taxis and buses are involved in accidents almost daily. These accidents can often lead to injuries to both the passengers and the drivers.

When passengers are injured in these accidents, they are often unsure whether they can file personal injury lawsuits. In most cases, the answer is yes.

However, the passenger may not be able to file the claim against the driver but against the company that employs the driver. This company may have insurance and be interested in settling the case quickly, but if the company believes the passenger was not traveling in a safe way, then that company may take the case to court.

The potential injuries that result from defective airbags

Posted on October 15th, 2009 No Comments

Before airbags were installed in most cars, people involved in car accidents would have a greater chance of sustaining severe injuries.

While airbags have been a safety breakthrough for cars, they also have led to their own types of injuries. Due to the design and possible defections with the airbag, people can be injured when the airbag is released.

These injuries can include head injuries, burns injuries, and broken bones. In some cases, if the airbag has a defect, then the injured party may be able to recover damages from the airbag manufacturer.
